Temuan Fakta Kesalahan Nyata Yang Dilakukan Mafia Hukum Menetapkan Unsur Seseorang Untuk dr. Tunggul P. Sihombing MHA

Dengan Menyatakan Sebagai Pejabat Pembuat Komitmen (PPK) TA 2008-2011. Berdasarkan Perintah Pasal 197 Ayat (1) Juncto Ayat (2) Juncto Pasal 143 Ayat (2) Butir (a Dan b) Juncto Ayat (3) UU Nomor 8 Tahun 1981 Tentang KUHAP, Seharusnya Sejak Dini Persidangan Tidak Boleh Dilanjutkan Atau Putusan Pengadilan DI Semua Tingkatan Harus Batal Demi Hukum Dan Korban Harus Lepas Bebas Demi Hukum. Penjelasan Berikut, Secara Singkat Menggambarkan Kesembronoan Pekerjaan :Mafia Hukum.

Berikut kronologinya:

Kesalahan Nyata Menetapkan dr. Tunggul P. Sihombing MHA Untuk Unsur Seseorang Vs Peran, Fungsi Vs Peraturan

Menimbang, bahwa Terdakwa Selaku PPK Bertanggung Jawab Dari Segi Administrasi, Fisik, Keuangan, Dan Fungsional Atas Pengadaan Barang/jasa Yang Dilaksanakannya Sebagaimana Tertuang DalamPasal 9 ayat (5) Peraturan Presiden Nomor 8 Tahun 2006 Tentang Perubahan Keempat Atas Keputusan Presiden Nomor 80 Tahun 2003 Tentang Pedoman PelaksanaanPengadaan Barang/Jasa Pemerintah). Hal Ini Mengabaikan:

1.NDP Adalah PPKI TA 2008 & DSM PPK III TA 2011

Berdasarkan Fakta Persidangan (Fakta Hukum Sebenarnya), Nandi Pinta Adalah PPK I DI TA 2008 Dan Desak Made Wismarini Sebagai PPK TA 2011.

2.Keberadaan Pengelola Proyek & Pejabat KPA

Panitia Pengadaan (Administrasi), Panitia Penerima (Fisik), Pejabat Penguji, Pejabat Yang Menetapkan Surat Perintah Membayar, Bendahara Pengeluaran (Keuangan), Tim Teknis / Ahli (Fungsional) Ditetapkan Dan Bertanggung Jawab Kepada Prof dr. Tjandra Yoga Aditama Sp P (K) Mars Dirjen P2PI Depkes RI Sebagai Pejabat KPA. Berdasarkan Keppres No 80 Tahun 2003 Tentang Pedoman Pelaksanaan Pengadaan Barang/Jasa Pemerintah, Pejabat KPA Bertanggung Jawab Dari Segi Administrasi, Fisik, Keuangan, Dan Fungsional Atas Pengadaan Barang/Jasa Yang Dilaksanakannya.

3.Peran, Fungsi & Pertanggung Jawaban Menteri Pelaku Kejahatan

Merujuk Pasal 4 UU Nomor 1 Tahun 2004 Tentang Perbendaharaan Negara, Menyatakan Bahwa: “Menteri/Pimpinan Lembaga Adalah Pengguna Anggaran/ Pengguna Barang Bagi Kementerian Negara/Lembaga Yang Dipimpinnya”, Termasuk Untuk Menetapkan Pengelola Proyek Yang Bertanggung Jawab Untuk Segi Administrasi, Fisik, Keuangan, Dan Fungsional Atas Pengadaan Barang/Jasa. Terlebih Lagi Bila Menteri Pelaku, Memerintahkan Mengetahui, Tidak Mengendalikan Berbagai Perbuatan Melawan Hukum, Adalah Mustahil Membuang Tanggung Jawab Atas Perbuatannya.

4.Penanggung Jawab Untuk Unsur Kerugian Keuangan Negara

Terdakwa Telah Terbukti Menyalahgunakan Kewenangan Yang Ada Padanya Karena Jabatan Atau Kedudukannya Sebagai PPK Dalam Proyek Pengadaan Peralatan Pembangunan Fasilitas Produksi, Riset dan Alih Teknologi Vaksin Flu Burung TA 2008 Sampai Dengan 2011. Telah Mengakibatkan Kerugian Negara sebesar Rp.770.077.582.590,-

5.Melindungi Pelaku Kejahatan Dengan Mengabaikan Indonesia Negara Hukum

Berbagai Perbuatan Melawan Hukum Yang Dilakukan SFS Menkes, AS Setjen Depkes RI, TYA Dirjen P2PL Depkes RI, Irjen Depkes RI Termasuk Pemilik / Pimpinan / Staf PT. AN DKK Sebagai Penyedia Barang / Jasa, Menjadi Dakwaan Dan Dasar Hukuman Untuk dr. Tunggul P. Sihombing MHA. Sedangkan Para Pihak Luput Dari Beban Pertanggung Jawaban Pidana Tanpa Ada Unsur Pemaaf.
