KESBANG.COM, JAKARTA – Setelah melalui serangkaian perundingan dan negosiasi yang berat dan ketat, pemerintah dan PT Freeport Indonesia akhirnya menyetujui sejumlah kesepakatan pada pertemuan hari Minggu (27/8) lalu. Pertemuan berlangsung di kantor Kementerian Energi dan Sumber Daya Mineral (ESDM) di Jakarta, dengan agenda finalisasi kesepakatan yang telah dihasilkan dari serangkaian pertemuan sebelumnya.

Dari pihak pemerintah hadir Menteri ESDM Ignasius Jonan selaku Ketua Tim Perundingan Pemerintah dan Menteri Keuangan Sri Mulyani Indrawati, jajaran Kementerian ESDM dan Kementerian Keuangan, serta wakil dari Kementerian terkait seperti Kemenko Perekonomian, Kemenko Maritim, Kementerian Hukum dan HAM, Kementerian LHK, Kementerian BUMN, Sekretariat Negara, dan BKPM. Dari pihak Freeport hadir President dan CEO Freeport McMoran Richard Adkerson dan direksi PT Freeport Indonesia.

“Seperti diketahui, Pemerintah dan PT Freeport Indonesia sepakat untuk menempuh jalur perundingan, guna menyelesaikan perselisihan yang terjadi setelah diberlakukannya Peraturan Pemerintah No. 1 tahun 2017,” ujar Menteri ESDM Ignasius Jonan dalam keterangan persnya.

Poin kesepakatan yang disetujui adalah:

  1. Landasan hukum yang mengatur hubungan antara Pemerintah dan PT Freeport Indonesia akan berupa Izin Usaha Pertambangan Khusus (IUPK), bukan berupa Kontrak Karya (KK).
  2. Divestasi saham PT Freeport Indonesia sebesar 51{45665f7ba399c739ef45db4b0b7facf8fd556e2bf7e2dcb92040db98cbf17eb2} untuk kepemilikan Nasional Indonesia. Hal-hal teknis terkait tahapan divestasi dan waktu pelaksanaan akan dibahas oleh tim dari Pemerintah dan PT Freeport Indonesia.
  3. PT Freeport Indonesia membangun fasilitas pengolahan dan pemurnian atau smelter selama 5 tahun, atau selambat-lambatnya sudah harus selesai pada Oktober 2022, kecuali terdapat kondisi force majeur.
  4. Stabilitas Penerimaan Negara. Penerimaan negara secara agregat lebih besar dibanding penerimaan melalui Kontrak Karya selama ini, yang didukung dengan jaminan fiskal dan hukum yang terdokumentasi untuk PT Freeport Indonesia.
  5. Setelah PT Freeport Indonesia menyepakati 4 poin di atas, sebagaimana diatur dalam IUPK maka PT Freeport Indonesia akan mendapatkan perpanjangan masa operasi maksimal 2×10 tahun hingga tahun 2041.

“Pemerintah dan PT Freeport Indonesia akan bekerja sama untuk segera menyelesaikan dokumentasi dari struktur yang disepakati, dan PT Freeport Indonesia akan mendapatkan persetujuan korporasi yang dibutuhkan,” lanjut Jonan.

Menurut Jonan, hasil perundingan ini sesuai dengan instruksi Bapak Presiden Joko Widodo untuk mengedepankan kepentingan nasional, kepentingan rakyat Papua, kedaulatan negara dalam pengelolaan sumber daya alam, serta menjaga iklim investasi tetap kondusif.
