medan-Puluhan massa dari DPW Jaringan Pendamping Kinerja Pemerintah ( JPKP) dan Komunitas Sahabat Indonesia( KSI) menggelar unjukrasa di depan gedung Pengadilan Negeri Medan, Senin (22/8/2022)

Massa datang ke depan gedung PN Medan sambil membawa spanduk yang bertuliskan, berantas mafia perkara dan tegakkan hukum dan keadilan di PN Medan

 

Kordinator Lapangan ( Korlap) massa JPKP Nicodemus Roger Nadeak dalam orasinya menjelaskan adanya rencana Juru Sita Pengadilan Negeri melaksanakan Eksekusi tanah di Jalan Kuda, Medan, Rabu 24 Agustus 2022 antara Lim Sun San/Halim Tjipta Sanjaya, Oei Giok Li Ng dengan Usman Ahmad Balatif dan Abdul Nasir terindikasi kejanggalan

Menurut Nicodemus, sengketa tanah tersebut ditengarai adanya permainan mafia perkara yang diduga memperalat oknum di Pengadilan Negeri Medan dan Polrestabes

Mencuatnya permasalahan ini,kata Nicodemus jangan memperburuk citra Kepolisian dan institusi pengadilan di Medan.

 

Nicodemus Nadeak dalam orasinya mengingatkan aparat Polrestabes dan Pengadilan Negeri Medan untuk tidak memihak serta segera membatalkan eksekusi yang syarat dangan adanya tekanan dari mafia perkara. Pihaknya meminta Kapolri dan Mahkamah Agung membersihkan oknum-oknum yang bermain dalam permasalahan ini.

“Kita tidak mau institusi pengadilan dan kepolisian tercoreng oleh oknum mafia perkara itu. Kami meminta eksekusi dibatalkan demi hukum dan kita juga mendesak kepada Kapolri dan Menkopolhukam agar menindak oknum-oknum yang terlibat,” kata Nicodemus didampingi Dedek Sumarna dari DPP KSI

Nicodemus menilai ada persoalan mendasar dalam kasus ini, dimana aparat tidak jeli sehingga masyarakat mencium adanya dugaan permainan dan tekanan mafia perkara dalam kasus ini.

“Pertama tanah tersebut merupakan milik Halim Tjipta Sanjaya dan sudah berkekuatan hukum tetap sesuai akta jual beli pada 10 Juli 1997. Tanah tersebut semula atas nama Yayasan Sech Oemar Bin Salim Bahadjadj dan statusnya telah menjadi Sertifikat Hak Milik atas nama Halim Tjipta Sanjaya dengan nomor 839/Pandau Hulu I tanggal 4 Februari 1997,” jelasnya.

Kedua, dalam perkara tersebut masih ada upaya hukum bantahan dan upaya hukum kasasi dari Halim Tjipta Sanjaya dan Oei Giok Li Ng sedang berjalan dalam proses dan belum ada putusan. “Kita melihat dalam proses ini seperti ada pemaksaan dan tekanan sehingga aparat sembrono dan tergesa-gesa,” katanya.

Kejanggalan berikutnya, dalam kasus ini pemohon eksekusi juga tidak memiliki legal standing atau dasar untuk mengajukan eksekusi. Dimana salah satunya pemohon sudah meninggal dunia atas nama Usman Ahmad dan pemohon lainnya atas nama eksekusi dinyatakan sebagai Daftar Pencarian Orang (DPO) terkait penggunaan surat palsu.

“Ini yang menjadi perhatian kita, Pemohon eksekusi sudah meninggal dan satu lagi juga dinyatakan DPO atas kasus pemalsuan surat. Kita minta aparat Kepolisian jeli. Maka itu kita menduga adanya permainan mafia perkara,” katanya lagi.

Yang paling mencengangkan kata Nicodemus, pemohon eksekusi dalam kasus ini tidak memiliki alas hak bukti kepemilikan seperti yang dimiliki saudara Halim Tjipta Sanjaya .”Selain pemohon tidak memiliki alas hak bukti, amar putusan juga tidak sesuai objek eksekusi,” tegasnya.

Sementara itu Dedek Sumarna menyesalkan oknum pengadilan dan Polrestabes diduga memperkeruh suasana penegakan hukum dan menghimbau agar eksekusi yang akan dilaksanakan 24 Agustus 2024 segera dibatalkan dan mengusut dugaan keterlibatan oknum tersebut. “Kita minta usut, demi penegakan hukum,” katanya

Nicodemus dan Sedekah Sumarna berjanji akan mengerahkan massa yang lebih besar lagi jika juru sita PN Medan tetap melaksanakan eksekusi

Menyahuti itu,Humas PN Medan Soniadi menyambut baik aspirasi massa itu.Namun dia berharap massa menyerahkan laporan atau bukti tertulis agar bisa disampaikan kepada Ketua PN Medan,” ujar juru bicara PN Medan tersebut

Akhirnya massa menyerahkan satu bundel bukti tentang sengketa tanah di Jalan Kuda kepada Humas PN Medan
