Meski sejauh ini belum ada pernyataan resmi dan tindakan konkrit yang dilakukan langsung oleh Presiden Jokowi terkait perpanjangan masa jabatan dirinya sebagai Presiden, namun hal ini telah menimbulkan pro-kontra diberbagai lapisan masyarakat.
Gagasan mengenai perpanjangan masa jabatan Presiden dan Jokowi 3 periode mengapung kembali setelah sebelumnya sempat meredup. Dukungan disampaikan oleh Nyoman Pasek, relawan Jaringan Pendamping Kebijakan Pembangunan (JPKP). Nyoman berharap Joko Widodo bisa kembali menjadi presiden setelah 2024 atau Jokowi 3 periode. Saat beruluk salam dengan Presiden di The Westin Resort & Spa Ubud, Bali, 2 Februari 2023 (Tempo 8/2/2023) .
Berlanjut bulan Maret 2022, Ketua Umum DPP Asosiasi Pemerintah Desa Indonesia (APDESI) Surta Wijaya juga menyerukan dukungan kepada Presiden Jokowi 3 periode. Seruan tersebut dikumandangkannya saat aksi di Istora Senayan pada Selasa 29 Maret 2022 lalu.
Pihaknya menilai dukungan kepada Jokowi harus didukung lantaran kepala desa merasa terbantu dengan pemerintahan Jokowi. Salah satunya Jokowi telah mengabulkan tuntutan para Kepala Desa (Kades) yakni mengubah aturan mekanisme gaji kepala desa dari tiga bulan sekali menjadi sebulan sekali.
Pernyataan Jokowi membingungkan. Dibeberapa kesempatan dirinya menyatakan penolakan wacana itu, namun disisi lain ia menyampaikan “bahwa dalam demokrasi kita tak boleh melarang jika ada yang usulkan masa jabatan presiden diperpanjang”, kira-kira demikian singkatnya kalimatnya.
Jokowi jangan malu-malu soal wacana perpanjangan jabatan dirinya. Justru dengan dia malu atau ragu malah akan membuat suasana kebangsaan jadi terganggu. Sebab kelompok satu dan lainnya saling- silang pendapat yang belum terucap langsung dari Jokowi dihadapan publik bahwa Jokowi inginkan perpanjangan masa jabatannya.
Baiknya jujur saja katakan jika keinginan perpanjangan jabatan presiden itu ada pada dirinya. Soal keinginannya nanti dikabulkan rakyat/DPR atau tidak itu soal lain. Paling tidak publik tak dibuat bingung setiap hari yang akibatnya cenderung bisa menimbulkan konflik. Kasian rakyat yang sudah susah hidupnya menghadapi kenaikan harga2, pengangguran, dll harus dihadapkan dengan bisingnya pro-kontra perpanjangan jabatan presiden, penundaan pemilu, dll.
Perpanjangan tiga periode masa jabatan presiden tidak dapat dilakukan secara sembarangan, melanggar konstitusi dan peraturan perundang-undangan yang berlaku di Indonesia. Akan tetapi ruang untuk menentukan ini diatur dalam UU.
Mekanisme untuk melakukan perubahan masa jabatan presiden tercantum dalam Pasal 7A dan Pasal 37 Undang-Undang Dasar 1945, yang menyatakan bahwa perubahan konstitusi hanya dapat dilakukan melalui Pemilihan Umum Konstituante dan melalui referendum yang dilakukan oleh rakyat.
Pembahasan perpanjangan masa jabatan presiden, harus dilakukan secara terbuka / jujur, melalui mekanisme konstitusi. Hal ini memerlukan konsensus dan kesepakatan yang luas di antara seluruh elemen masyarakat dan pihak-pihak terkait, dengan memperhatikan kepentingan nasional dan prinsip-prinsip demokrasi yang berlaku di Indonesia.
Jika perpanjangan masa jabatan tidak melewati proses keterbukaan, mekanisme konstitusi, maka hal tersebut akan melanggar konstitusi dan peraturan perundang-undangan yang berlaku di Indonesia.
Hal itu dapat menimbulkan berbagai dampak negatif, yakni melemahnya demokrasi menjadi lemah, dan prinsip-prinsip keadilan menjadi hilang, terjadinya ketidakpuasan dan ketidakstabilan yang berpotensi memicu protes dan konflik, merusak citra negara di mata dunia internasional yang berdampak pada hubungan bilateral dan kerjasama internasional Indonesia dengan negara lain.
Oleh karena itu, maka sangat penting bagi Presiden Jokowi (pemerintah) dan DPR untuk tetap menghormati konstitusi dan aturan yang berlaku, dengan jalankan segala tindakan secara transparan dan akuntabel untuk memastikan keamanan, kestabilan, dan kemajuan Indonesia sebagai negara demokratis.
Sebagai bahan pertimbangan, berikut fakta sejarah negara-negara yang telah melaksanakan perpanjangan masa jabatan presiden secara inkonsitusional yang mengakibatkan kekacauan didalam negerinya.
1. Republik Demokratik Kongo Pada tahun 2015, Presiden Joseph Kabila memperpanjang masa jabatannya setelah masa jabatannya habis. Keputusan ini menimbulkan protes di seluruh negeri dan memicu kekerasan di beberapa wilayah Kongo.
2. Venezuela Pada tahun 2017, Presiden Nicolas Maduro memperpanjang masa jabatannya selama dua tahun. Keputusan ini memicu protes besar-besaran di Venezuela dan meningkatkan ketegangan politik di dalam negeri.
3. Zimbabwe Pada tahun 2017, Presiden Robert Mugabe memperpanjang masa jabatannya selama 5 tahun. Keputusan ini memicu protes di Zimbabwe dan membuat militer mengambil alih kekuasaan dalam kudeta yang akhirnya menggulingkan Mugabe.
