Setelah membahas dugaan kasus gratifikasi Menko Marves Luhut Binsar Pandjaitan (LBP) pada tulisan pertama, pada tulisan kedua ini diurai sepak terjang LBP pada kasus Big Data. LBP mengklaim memiliki Big Data tentang “aspirasi 110 juta suara warganet”, yang disebut telah menyatakan keinginan agar Pemilu 2024 ditunda.

Aspirasi politik 110 juta warganet tersebut tampaknya hanya utopia. LBP pun tidak mampu menunjukkan kebenarannya. Meski telah diminta berbagai kalangan, LBP tidak pernah mengungkap esensi klaim. Artinya, jika hanya bicara jumlah, tanpa kejelasan profil warga dan aspirasi politiknya, maka Big Data 110 juta warganet tersebut memang tidak ada dan tidak merepresentasikan apapun. Artinya hal itu hanya klaim tanpa dasar atau big bluff menggiring opini publik guna mencapai target politik, sambil menggunakan posisi sebagai penguasa.

LBP menganggap ungkapan Big Data merupakan informasi normal yang harus diterima publik. Tampaknya sikap arogan, otoriter, serta melanggar prinsip moral dan hukum ini sangat confident dijalankan, karena LBP merasa sangat berkuasa, serta diduga direstui dan didukung pula oleh pemimpin tertinggi atau “The Real President” dan oligarki. Tujuannya, meraih agenda politik penguasa oligarkis, terutama agar Presiden Jokowi dapat menduduki jabatan Presiden RI periode ke-3.

Di sisi lain, meski diduga berada pada arah dan tujuan yang sama, tampaknya Presiden Jokowi merasa perlu menjaga jarak terhadap berbagai agenda dan aksi-aksi yang dijalankan LBP, sang master mind utama Jokowi 3 periode. Jika hasil “test the water” tidak sesuai harapan atau “unfavourable”, maka “The Real President” seolah tidak terlibat dan bisa pula tampil sebagai pahlawan demokrasi yang taat amanat reformasi dan konstitusi.

Pada sidang Kabinet Paripurna (Istana Merdeka, 6/4/2022), Presiden Jokowi mengatakan: “Jangan menimbulkan polemik di masyarakat. Fokus pada bekerja dalam penanganan kesulitan-kesulitan yang kita hadapi”. Jokowi pun juga menyatakan: “Jangan sampai ada lagi yang menyuarakan mengenai penundaan perpanjangan, ndak, saya rasa itu yang ingin saya sampaikan, terima kasih”.

Karena telah faham sikapnya selama ini, tampaknya mayoritas publik tidak akan percaya pernyataan Presiden Jokowi di atas. Salah satunya, belajar dari hasil evaluasi dan penilaian BEM Universitas Indonesia terhadap Jokowi yang menyebutnya sebagai “The King of Lip Service” atau “Raja Pembohong” (26/2/202). Jokowi memang perlu membuat pernyataan tersebut karena “permainan” Big Data sarat masalah dan LBP perlu bertanggungjawab. Namun karena bagian penting dari permainan, diperkirakan Presiden Jokowi tidak akan menindak LBP yang telah melakukan kebohongan Big Data.

Faktanya hampir semua lembaga survei menyatakan mayoritas masyarakat tidak setuju perpanjangan masa jabatan Presiden. Tidak ada satu pun lembaga survei yang mengonfirmasi hasil analisis Big Data LBP. Sejumlah lembaga justru mengkonter klaim manipulatif yang disampaikan LBP. Saiful Mujani Research and Consulting (SMRC) menyampaikan hasil survei yang dilakukan pada Maret 2022. Hasil survei SMRC disampaikan pada 3 April 2022. Terungkap 85% publik di medsos tetap ingin pemilu dilaksanakan pada 14 Februari 2024.

Sedangkan menurut Lingkaran Survey Indonesia (LSI) mayoritas warga (di atas 70%) yang disurvei menolak usul penundaan pemilu, terutama karena alasan ekonomi, pandemi Civid-19, dan rencana pembangunan Ibu Kota Negara (IKN) baru (3/3/2022). Lembaga Survei Nasional (LSN) juga mengungkap yang hasil yang sama (3/3/2022). Mayoritas publik (68,1%) yang disurvei tidak setuju penundaan pemilu dan sekaligus perpanjangan masa jabatan Jokowi.

Secara umum hasil survei lembaga-lembaga di atas menunjukkan klaim big data LBP penuh misteri, sarat kebohongan dan sangat tidak layak dipercaya. Dengan begitu para penggagas dan desainer agenda anti demokrasi tersebut harus tahu diri dan segera mengakhiri rencana busuk. Namun begitu, setelah sekian testing atau permainan, karena belum berhasil sesuai harapan, bisa saja muncul modus atau permainan baru penundaan pemilu (baca: Jokowi 3 Periode), di bawah koordinasi dan kendali “The Real President”, LBP.

Sebelum modus baru tersebut muncul, rakyat harus menggugat kebohongan Big Data LBP. Terutama terkait aspek-aspek landasan hukum, metode hingga tujuan pengumpulan data. Lembaga penegak hukum, Komisi Informasi dan lembaga terkait harus mengungkap landasan hukum yang digunakan LBP mengumpulkan Big Data. Lalu perlu dijelaskan kapan dan bagaimana metode pengumpulan, serta harus dijelaskan pula siapa saja 110 juta pengguna internet yang dimaksud LBP, dan apa tujuan LBP mengumpulkan data tersebut.

Dalam Pasal 11 ayat (1) huruf f UU No.14/2008 diatur bahwa informasi yang disampaikan pejabat publik dalam pertemuan terbuka untuk umum harus dapat dijelaskan kepada masyarakat secara rinci sesuai kaidah yang berlaku. Karena sangat ambius mencapai target Jokowi 3 Periode, untuk kasus Big Data, LBP telah membuat pernyataan sepihak dan cenderung menghalalkan segala cara.

Karena banyak pihak menggugat klaim Big Data, LBP menyatakan: “Ya pasti ada lah (Big Data), masa bohong. Tapi janganlah (dibuka ke publik), buat apa dibuka,” katanya (16/3/2022). Kita tidak tahu apakah LBP paham dengan ketentuan UU No.14/2008 di atas. Sebaliknya, seandainyapun paham, bisa saja LBP mengabaikan. Rezim ini tampaknya sudah biasa berdiri di atas UU.

Sesuai dengan perintah UU No.14/2008 pula, pada 30 Maret 2022, Indonesia Corruption Watch (ICW) telah menyampaikan surat permintaan informasi publik kepada LBP di kantor Kemenko Marves. Saat itu LBP belum memberi jawaban. Namun sesuai Pasal 22 ayat (7) UU No.14/2008, surat permintaan informasi publik harus dijawab dalam rentang waktu sepuluh hari kerja. Merujuk pernyataan sikap LBP pada 16 Maret 2022, ICW tampaknya tidak akan memperoleh jawaban dari LBP.

Kebijakan pro oligarki yang dijalankan Pemerintahan Jokowi selama ini sudah sangat banyak merugikan rakyat dan negara seperti UU Ciptaker, UU Minerba, Perppu Korona, pembangunan smelter nikel China, TKA China, listrik swasta skema take or pay, impor pangan, harga minyak goreng pro oligarki, dll. Kebijakan tersebut akan ditambah pula dengan proyek IKN yang pada dasarnya memang dibangun untuk kepentingan oligarki! Tampaknya, jaminan realisasi proyek IKN inilah mengapa masa jabatan Presiden Jokowi harus diperpanjang: 3 periode!

Sebelum pemerintah pro oligarki semakin merusak demokrasi, mengkudeta suara rakyat dan merugikan kehidupan berbangsa, maka salah satu master mind utama yang terus menggulirkan agenda penundaan pemilu secara sistematis di lingkaran kekuasaan, yakni LBP, harus dihentikan. Meskipun “dilindungi” oleh Presiden Jokowi, LBP harus dituntut secara hukum karena diduga telah melakukan kebohongan publik. LBP pun harus diproses secara hukum karena diduga telah melanggar UU No.14/2008 tentang Keterbukaan Informasi Publik (KIP).
