Rakyat Menggugat Sepak Terjang LBP (3): Pelindung Konglomerat Pengembang Properti Terlibat Dugaan KKN

Dalam tulisan ke-3 ini dibahas peran Menko Marves Luhut Binsar Pandjaitan (LBP) dalam kasus yang melibatkan sejumlah konglomerat pengembang properti. Dalam proyek reklamasi Teluk Jakarta, hampir semua pengembang properti terkemuka mendapat jatah membangun “pulau-pulau” reklamasi. Proyek rekalamasi adalah contoh nyata proyek oligarki kekuasaan di Indonesia. Misalnya, merekalah yang mengusung Ahok pada Pilkada DKI 2017.

Karena sarat pelanggaran dan digugat publik, Menko Rizal Ramli menghentikan proyek tersebut. Karena berani menghentikan proyek ini, justru Rizal digusur oligarki. Rizal kemudian digantikan oleh LBP yang bertekad melanjutkan proyek. Kata LBP: “Iya (tetap lanjut). Tidak ada masalah kok. Kamu kalau temukan ada masalah, tunjukkan, kesalahannya ada dimana” (11/7/2017). Proyek yang sebelumnya dihentikan Rizal, kembali dilanjutkan LBP.

Setelah Anies Baswedan menjadi Gubernur DKI, proyek reklamasi dihentikan, kecuali 4 pulau (C, D, G dan N) yang terlanjur dibangun secara illegal. Pada 6 September 2018, Anies mencabut izin 13 pulau reklamasi melalui SK No.1409/2018. Mega proyek reklamasi adalah bisnis properti 17 pulau (A s.d M) seluas 70.000 ha (Jakarta Pusat hanya 48.000 ha) oleh puluhan konglomerat dan potensi untung Rp 516 triliun. Nilai sangat besar menjadi alasan mengapa LBP pasang badan untuk bisnis para konglo. Proyek oligarki yang harus berlanjut.

LBP pernah mengancam Anies karena penghentian proyek: “Saya enggak lihat ada alasan, tapi kalau mau disetop, ya, bikin aja situ setop, nanti kalau sudah Jakarta tenggelam atau menurun, tanggung jawab. Jadi, jangan lari tanggung jawab” (8/5/2017). LBP mengingatkan kewenangan pejabat pemerintah, baik menteri, gubernur, bahkan presiden sekalipun. LBP bilang Anies harus taat aturan dan kewenangan ketika stop reklamasi. “Jangan anggap jadi Gubernur DKI lantas semua bisa dikerjakan, tidak dapat begitu” kata LBP.

Pada 24 April 2018 LBP mengingatkan Anies: “Kalau dia resisten, ya lihat aja. Silahkan ditunjukkan resistensinya dimana. Saya enggak ada urusan. *Tapi jangan bilang macam-macam sama saya, saya kejar siapa pun dia”*. Terkait kepastian investasi LBP bilang: “Ya, secara profesional saya pertanggungjawabkan, siapa pun dia. *Mau siapa dia ngomong ke sini. Jangan asal ngomong aja republik ini dia pikir apa. Emang dia siapa? Ngomong yang benar gitu”*. Inilah gaya bicara LBP yang arogan!

Jawaban Anies: “Justru karena kita menggunakan aturan, maka kita mau tertibkan”. Menurut Anies dalam Pasal 4 Kepres No.52/1995 wewenang reklamasi di tangan gubernur. Yang terjadi sekarang, ada pengembang yang sudah bikin gedung tinggi dan besar tanpa ikut aturan. Belakangan mereka minta diberi izin karena sudah keluar uang banyak, sudah investasi.

Ternyata para pengembang bukan saja melanggar hukum, tapi merusak lingkungan, mengganggu mata pencaharian nelayan dan terlibat suap-menyuap. Hal ini terbukti dalam sejumlah putusan Pengadilan Tata Usaha Negara (PTUN) yang memenangkan Gubernur Anies dan menolak gugatan para pengembang yang izin dicabut. Terbukti ancaman LBP di atas tidak relevan dan tidak valid. Bahkan LBH Jakarta menilai LBP melanggar pinsip GCG, melecehkan pengadilan, serta melindungi mega korupsi yang dilakukan pengembang.

Ke depan, karena “kemampuan para pengembang mempengaruhi” pengadilan tingkat lebih tinggi (MA), ditambah peran LBP, bisa saja izin-izin “hidup kembali”. Contohnya izin reklamasi Pulau H konon telah dimenangkan pengembang (3/9/2021). Artinya kepentingan lingkungan, nelayan, akses publik, dan otonomi daerah bisa saja dinihilkan. Oleh sebab itu, rakyat harus melawan upaya oligarki dan LBP yang diduga sarat moral hazard tsb.

*Proyek Meikarta*
Terkait proyek Meikarta, LBP memastikan semua perizinan dan kepemilikan tanah Proyek Meikarta tidak masalah. “Saya tanya Pak James (Riady) mengenai semua masalah perizinan dan kepemilikan tanah. (Dia jawab) semua tidak ada masalah”(29/10/2017).

Setahun kemudian, meski Lippo terlibat penyuapan, LBP masih membela Lippo Group. Kata LBP: “Saya melihat betapa Pak James Riady mempertaruhkan reputasi Lippo Group membangun kawasan yang sudah dipersiapkan selama 20 tahun” (16/10/2018).

Ternyata, proyek Meikarta bernilai Rp 278 triliun dibangun tanpa izin peruntukan penggunaan tanah (IPPT), tanpa Amdal, tanpa IMB, melanggar Perda No.12/2011 Tata Ruang Kabupaten Bekasi, UU No.20/2011 Rumah Susun, dan Perda Jabar No.12/2014 Pembangunan dan Pengembangan Metropolitan dan Pertumbuhan. Selain itu Lippo terlibat kasus penyuapan.

Berbagai pelanggaran di atas terbukti di pengadilan tipikor. 10 orang masuk penjara, 5 orang dari pemda (termasuk Bupati Bekasi Neneng Hasanah dan Sekda Jabar Iwa Karniwa) dan 4 orang dari Lippo (termasuk Billy Sindoro dan Bartholomeus Toto).

Pada 5 April 2020, meski kasus kejahatan pemilik Meikarta sudah terang benderang, LBP masih membela Lippo dengan mengatakan investor yang menanam modal justru menjadi tahanan KPK. Kata LBP: “Karena investor sudah menginvestasikan uang mereka, tapi pemerintah daerah minta ini dan itu. Dan ketika mereka memberikan sesuatu untuk pemda, mereka malah ditangkap KPK yang saya pikir itu hal yang sangat buruk” (5/2/2020).

Faktanya Lippo Group telah membangun properti illegal sesuka hati, seakan berada di atas negara, dan memasarkan produk illegal secara massif. Guna meraih izin Lippo menyuap pejabat. Akibatnya banyak konsumen tertipu karena pelanggaran hukum dan kebohongan. Semua kejahatan telah terbukti di pengadilan. Meski begitu, LBP masih membela Lippo. Wajar jika rakyat menggugat LBP dan juga Jokowi yang mempertahan LBP.

Selama ini pemerintahan oligarkis, membuat taipan terlibat korupsi dan penyuapan bisa lolos proses hukum. Pemilik Agung Podomoro *Sugianto Kusuma bersama Ahok* lolos jerat KPK walau alat bukti lebih dari cukup. *Berkat perlindungan penguasa oligarkis, terutama LBP, James Riady juga telah lolos dari penjara. Bahkan James Riyadi malah diangkat oleh Pemerintahan Jokowi menjadi anggota Satgas Omnibus Law* (10/10/2020). Fatal!

LBP berada di garis depan membela dan melindungi pemilik proyek Reklamasi dan Meikarta yang terlibat kejahatan dan KKN. Kedua proyek merupakan pendukung eksistensi pemerintahan oligarki. Karena kedua proyek gagal, sementara para konglomerat yang telah “banyak berkorban” saat pemilu dan pilkada, maka perlu dikompensasi dengan proyek baru. Itulah mengapa Proyek IKN Baru harus jalan!

Di samping kompensasi proyek gagal, proyek IKN adalah objek berburu rente BESAR, modus mempertahankan eksistensi oligarki, dan alat memenuhi kepentingan China. Padahal, IKN adalah proyek mercu suar yang sangat tidak layak dibangun. Dalam kondisi negara normal saja proyek IKN tidak dibutuhkan dan tidak layak. Apalagi jika dampak pandemi, keuangan negara yang morat-marit, hutang menggunung, ekonomi bermasalah, kemiskinan meningkat, dan daya beli rakyat semakin menurun. Maka pembangunan IKN semakin tidak layak.

Sebagai kesimpulan, terlihat bahwa pelanggaran hukum dan dominasi oligarki sangat mewarnai Pemerintahan Jokowi, di mana salah satu aktor utamanya LBP. Jika tidak segera dihentikan, penyelewengan dan dominasi oligarki akan semakin merusak kehidupan rakyat dan meruntuhkan kedaulatan negara. Rakyat harus bersatu menggugat LBP dan Pemerintahan Jokowi yang melindungi para terduga koruptor proyek Reklamasi dan Meikarta, serta memaksakan proyek IKN yang sarat kepentingan dominasi oligarki dan China.[]
