Rakyat Menggugat Sepak Terjang LBP (4): Oligarki dan Investor China Merampok SDA Nikel Nasional

Indonesia adalah negara produsen dan pemilik cadangan bijih mineral nikel terbesar dunia, yakni 4.59 miliar ton (24%). Negara-negara pemilik cadangan nikel terbesar berikut: Australia (23%), Brazil (12%), Rusia (8%), Cuba (5%), dan lain-lain. Namun begitu, rakyat Indonesia bukanlah penerima manfaat terbesar SDA nikel nasional. Pihak-pihak yang memperoleh untung BESAR adalah China, investor China, TKA China dan pengusaha oligarkis.

Mengapa bisa demikian? Karena Pemerintahan Jokowi yang dimotori LBP memang telah menerbitkan berbagai kebijkan yang membuat pihak-pihak tersebut di ataslah yang menjadi penerima manfaat terbesar industri nikel. Kebijakan-kebijakan dimaksud merambah hampir seluruh lini industri nikel, mulai dari hulu hingga hilir, dari pajak hingga bea masuk, dan sampai pada TKA China yang bebas masuk melanggar aturan Covid dan datang hanya dengan Visa Kunjungan, bukan Visa Kerja!

Padahal sesuai Pasal 33 UUD 1945 mineral nikel harus memberi manfaat bagi sebesar-besar kemakmuran rakyat. Untuk itu pengelolaan SDA nikel harus berada di tangan Badan Usaha Milik Negara (BUMN). Ternyata BUMN kita (Antam) hanya menguasai sekitar 7-8% saja dalam bisnis tambang dan smelter nikel nasional (termasuk pemilikan saham Antam pada VALE). Ironisnya, Pemerintah Jokowi pun memilih untuk “membeli” saham VALE, padahal berkesempatan menguasai saham mayoritas melalui mekanisme perpanjangan kontrak.

Dominasi investor China dan oligarki dimulai saat pemerintah, melalui LBP, mempercepat larangan ekspor bijih nikel. Kebijakan terbit beberapa hari setelah kunjungan pejabat dan investor China kepada Presiden Jokowi di Istana Merdeka pada bulan Juli 2019. Dua minggu setelah kunjungan, pada 12 Agustus 2019 larangan ekspor muncul dari Menko Kemaritiman LBP (bukan dari MESDM, Jonan!). Alasannya, stok nikel dari larangan ekspor masih bisa diserap “smelter lokal” milik China dan oligarki: PT Sulawesi Mining Investment (SMI), PT Virtue Dragon Nickel Industry (VDNI), PT Huadi Nickel Aloy (HNA), dan PT Harita Nickel.

Kebijakan larangan ekspor sarat moral hazard ini terbukti telah merugikan penambang lokal/pribumi. Mereka terpaksa menjual hasil tambang kepada smelter China dan oligarki yang disebut di atas, dengan harga lebih murah dibanding harga internasional. Harga Patokan Mineral (HPM) yang dirujuk dalam penjualan tersebut diatur oleh pemerintah dan oligarki melalui praktek kartel investor & konglo, rekayasa batasan kadar nikel, pemanfaatan lembaga survei abal-abal kredibel, dll.

Karena harga jual yang rendah ditambah beban membayar royalti dan PPh, pembangunan smelter pengusaha-pengusaha domestik yang seharusnya dibantu pemerintah, gagal terlaksana. Sebaliknya, melalui larangan ekspor dan pemaksaan harga rendah, LBP dan Jokowi justru membantu investor China dan oligarki dapat untung BESAR. Bahkan karena investor smelter China/konglo bebas bayar royalti, PPh, dan pajak/bea ekspor, maka pendapatan negara pun berkurang! *“Sistem” LBP & Jokowi telah bekerja sangat baik bagi investor China/konglo.*

*Selanjutnya,* LBP telah pula bekerja efektif memasukkan TKA China ke Indonesia saat pandemi korona sedang marak. Jangankan kedatangan internasional, perjalanan domestik untuk seluruh rakyat Indonesia saat itu dilarang. Ternyata, akibat kekuasaan LBP yang seolah tanpa batas, aturan kedatangan tersebut tidak digubris. Rakyat Indonesia dilarang bepergian, tapi tidak untuk TKA China! Alasan utama LBP: untuk menjamin terlaksananya investasi China. LBP mengangkangi UU dan peraturan yang berlaku.

Maka, selama pandemi Covid-19, ada sekitar 10.482 TKA China masuk Indonesia menuju smelter-smelter yang ada di Sulawesi dan Maluku. Padahal Menaker mengeluarkan Surat Edaran M.1.HK.04/II/2020 tentang pelarangan sementara penggunaan TKA asal China akibat wabah sejak Februari 2020. Antara Januari-Februari 2021, ada 1.460 TKA China yang masuk. Pelanggaran ini pun “melawan” kebijakan Presiden melarang masuknya warga asing mulai Januari 2021. LBP jelas melangkahi hukum! Tampaknya Presiden pun bersikap hipokrit!

Berikutnya, LBP membohongi publik terkait kualifikasi tenaga kerja. LBP berdalih TKA China perlu didatangkan karena tenaga kerja lokal tidak memenuhi syarat. Kata LBP: “Kita lihat banyak daerah-daerah (penghasil) mineral kita pendidikannya tidak ada yang bagus. Jadi kalau ada banyak yang berteriak tidak pakai (tenaga kerja) kita, lah penduduk lokalnya saja pendidikannya enggak ada yang bagus. Misalnya saja matematika rendah” Selasa (15/9/2020).

Padahal puluhan ribu TKA China yang bekerja di smelter-smelter China/konglo, seperti VDNI, OSS, dan SMI, mayoritas berijazah SD, SMP dan SMA. Faktanya lebih dari 93% TKA China bekerja di VDNI dan OSS berijazah SD, SMP dan SMA, dan bergaji 3 – 4 kali lipat lebih besar dibanding gaji pekerja domestik. Sebagian besar gaji TKA China dibayar di China. Rezim Jokowi telah merampok hak pekerja domestik, diskriminatif, merendahkan martabat dan menghina bangsa sendiri, disebut berpendidikan rendah dan buruk (gak ada yang bagus).

Selanjutnya, LBP juga sangat berperan dalam pemberian berbagai insentif, yang mestinya diatur oleh Kemenku, kepada investor China dan pengusaha oligarkis berupa: 1) bebas Bea Masuk; 2) bebas Royalti; 3) Tax Holiday; 4) bebas PPN; 5) bebas Pajak Ekspor; 6) bebas PPH-21, Iuran Izin Tinggal Terbatas (ITAS) dan Dana Kompensasi Penggunaan TKA (DKPTKA) karena TKA China menggunakan visa kunjungan 211 (bukan visa kerja 311).

Hanya dari pembebasan pungutan ITAS dan DKPTKA atas TKA China yang bekerja dengan *Visa Kunjungan* pada puluhan smelter China di Sulawesi dan Maluku, negara kehilangan pendapatan sekitar Rp 3.78 triliun per tahun. Jika ditambah kebijakan larangan ekspor dan berbagai insentif yang diberi pemerintah, maka NKRI kehilangan pendapatan puluhan triliun Rp setiap tahun. Sebalinya, kehilangan ini menjadi untung BESAR bagi China, investor China dan para pengusaha pendukung rezim oligarkis.

Di samping kerugian negara puluhan triliun per tahun, kebijakan pemerintah pada industri nikel telah melanggar, UU No.13/2013 tentang Ketenagakerjaan, Permen Naker No.10/2018 tentang Tata Cara Penggunaan TKA, Kepmen Naker No.228/2019 tentang Jabatan Tertentu oleh TKA, dan UU No.6/2011 tentang Keimigrasian. Berbagai pelanggaran ini, berikut kerugian negara yang diuraikan di atas, telah disampaikan kepada Komisi II, VII, IX dan XI DPR. Namun tidak mendapat perhatian dan proses lebih lanjut sebagaimana mestinya.

Skandal industri nikel ini harus diproses hukum. VDNI, OSS dan seluruh perusahaan yang mempekerjakan TKA China harus diaudit. Mereka harus dipidana karena minimal telah melanggar Pasal 63 ayat 2 dan 3, serta Pasal 122 huruf a dan b UU No.6/2011 tentang Keimigrasian. DPR dan BPK pun dituntut mengusut dan mengaudit berbagai kebijakan sektor industri nikel yang diduga sarat prilaku moral hazard. Selain itu, rakyat harus menggugat LBP dan Presiden Jokowi yang telah membuat kebijakan yang sangat merugikan negara dan rakyat, salah satunya dengan menggunakan hasil audit.[]
