*Jakarta* – Rapat Gabungan (Ragab) Pimpinan MPR dengan Pimpinan Fraksi dan Kelompok DPD yang juga diikuti Pimpinan Badan Pengkajian MPR menyepakati pembentukan Panitia Ad Hoc untuk menindaklanjuti hasil kajian Badan Pengkajian MPR berupa rancangan substansi Pokok Pokok Haluan Negara (PPHN) dan bentuk hukum PPHN. Bamsoet menjelaskan Panitia Ad Hoc ini merupakan alat kelengkapan MPR yang akan mempersiapkan rancangan keputusan MPR terkait PPHN.

“Ragab Pimpinan MPR dan Pimpinan Fraksi dan Kelompok DPD menyatakan dapat menerima laporan Badan Pengkajian yang telah menyelesaikan tugas melakukan kajian substansi dan bentuk hukum PPHN. Ragab juga sepakat untuk menindaklanjuti hasil kajian Badan Pengkajian MPR dengan membentuk Panitia Ad Hoc, yang kemudian diambil keputusan melalui Sidang Paripurna MPR. Komposisi Panitia Ad Hoc terdiri dari 10 pimpinan MPR dan 45 anggota panitia Ad Hoc dari fraksi dan kelompok DPD secara proporsional,” kata Ketua MPR Bambang Soesatyo usai Ragab Pimpinan MPR dengan Pimpinan Fraksi dan Kelompok DPD, di Ruang Delegasi, Komplek Parlemen Jakarta, Senin (25/7/2022).

Rapat Gabungan Pimpinan MPR dengan Pimpinan Fraksi dan Kelompok DPD dipimpin Ketua MPR Bambang Soesatyo didampingi para Wakil Ketua yaitu Ahmad Basarah, Yandri Susanto, dan Arsul Sani, serta Lestari Moerdijat yang mengikuti secara virtual. Pimpinan Fraksi dan Kelompok DPD di antaranya Tb Hasanuddin (PDI Perjuangan), Sodik Mujahid (Partai Gerindra), Idris Laena (Partai Golkar), Neng Eem Marhamah (PKB), Benny K Harman (Partai Demokrat), Tiffatul Sembiring (PKS), Jon Erizal (PAN), M. Iqbal (PPP), dan Tamsil Linrung (Kelompok DPD). Ragab juga diikuti Ketua Badan Pengkajian MPR Djarot Saiful Hidayat.

Bambang Soesatyo mengungkapkan Badan Pengkajian MPR telah menyelesaikan tugasnya melakukan kajian dengan hasil berupa rancangan PPHN dan kajian bentuk hukum. Badan Pengkajian juga telah sepakat menghadirkan PPHN tanpa melalui amandemen UUD NRI Tahun 1945. “Dalam rapat pimpinan MPR bersama Pimpinan Badan Pengkajian pada 7 Juli 2022, disepakati agar mengupayakan PPHN melalui konvensi ketatanegaraan. Ini adalah upaya terobosan baru yang dilakukan oleh Badan Pengkajian,” kata Bamsoet, sapaan Bambang Soesatyo.

Bamsoet menambahkan gagasan konvensi ketatanegaraan itu juga telah disampaikan kepada Presiden dalam pertemuan konsultasi Pimpinan MPR dengan Presiden pada tanggal 14 Juli 2022. “Kita sampaikan bahwa idealnya PPHN diatur dalam Ketetapan MPR dengan melakukan perubahan terbatas UUD NRI Tahun 1945. Namun melihat dinamika politik maka perubahan terbatas UUD itu sulit untuk direalisasikan. Presiden Jokowi menyerahkan sepenuhnya kepada MPR,” katanya.

Menurut Bamsoet, dari pilihan bentuk hukum hasil kajian Badan Pengkajian MPR, ada ruang dalam pasal 100 ayat 2 Tata Tertib MPR bahwa Ketetapan MPR dapat dilakukan melalui konvensi ketatanegaraan. “Sepertinya tidak ada pilihan lain kita harus membentuk Panitia Ad Hoc MPR sesuai Pasal 34 Tata Tertib MPR,” ujarnya.

Dalam pasal itu disebutkan “Panitia Ad Hoc merupakan alat kelengkapan MPR yang dibentuk oleh MPR dalam Sidang Paripurna MPR untuk melaksanakan tugas tertentu yang diperlukan.” Sedangkan dalam Pasal 36 ayat 1 Tata Tertib MPR, disebutkan Panitia Ad Hoc terdiri atas pimpinan MPR dan paling sedikit 5% dari jumlah anggota dan paling banyak 10% secara proporsional dari Fraksi dan kelompok DPD.

Untuk membuat Keputusan MPR harus melakukan tiga tingkatan pembicaraan, yaitu pembahasan dalam sidang paripurna MPR yang didahului oleh penjelasan pimpinan MPR, dilanjutkan dengan pandangan umum fraksi dan kelompok DPD. Kemudian tingkat II, pembahasan oleh Panitia Ad Hoc terhadap semua hasil pembicaraan tingkat I, dan hasil pembahasan pada tingkat II, dan inilah rancangan keputusan MPR. Pada tingkat III, pengambilan keputusan oleh sidang paripurna MPR, setelah mendengar laporan pimpinan Panitia Ad Hoc, dan bila perlu kata akhir dari fraksi dan kelompok DPD.

“Untuk pembentukan Panitia Ad Hoc, maka perlu penyelenggaraan Sidang Paripurna MPR di luar Sidang Tahunan MPR yang akan diselenggarakan pada 16 Agustus 2022. Karena masih reses dan renovasi gedung, maka sidang paripurna MPR pembentukan Panitia Ad Hoc, akan diselenggarakan pada awal atau pertengahan September 2022,” jelas Bamsoet.

Rancangan komposisi Panitia Ad Hoc, terdiri dari pimpinan MPR ditambah 45 anggota secara proporsional dari fraksi dan kelompok DPD. Komposisi keanggotaan Panitia Ad Hoc, adalah pimpinan MPR 10 orang, fraksi PDIP 8 orang, fraksi Partai Golkar 5 orang, fraksi Partai Gerindra 5 orang, Fraksi Partai Nasdem 4 orang, Fraksi PKB 4 orang, Fraksi Partai Demokrat 3 orang, Fraksi PKS 3 orang, Fraksi PAN 3 orang, Fraksi PPP 1 orang, dan Kelompok DPD 9 orang.
