Mengapa saya jawab dengan kata; ‘Alhamdulillah’, ketika presenter Kompas TV menanyakan komentar saya atas penolakan Mahkamah Konstitusi terhadap gugatan DPD RI terhadap Pasal 222 UU Pemilu tentang ambang batas pencalonan presiden?

Karena saya bersyukur. Berarti ladang amal ibadah kami di DPD RI untuk terus bekerja memperbaiki kondisi negara ini diberi waktu lebih panjang lagi. Tugas negara ini diperluas. Sekaligus diperberat. Sehingga benar-benar harus fundamental.

Bagi saya, beginilah cara Allah SWT memberi hikmah atas ketetapan-Nya. Sehingga harus kita yakini, perjuangan ini akan menjadi ladang jariyah bagi kita semua.

Sehingga saat itu saya katakan, penolakan MK adalah kemenangan sementara Oligarki. Tetapi bukan kemenangan abadi. Karena kemenangan abadi akan diraih oleh rakyat Indonesia, sebagai pemilik negara ini.

Pemerintah silih berganti. Pejabat negara juga silih berganti. Semua akan meninggalkan dunia ini. Hakim MK juga akan mati. Oligarki —sekaya apapun– juga akan mati. Tetapi rakyat dan negara ini harus tetap ada. Karena tunas-tunas generasi bangsa masih dilahirkan di bumi pertiwi ini. Masa depan merekalah yang harus kita perjuangkan hari ini.

Karena itu saya katakan juga melalui siaran pers saya dari Makkah, bahwa saya akan memimpin gerakan untuk mengembalikan kedaulatan rakyat. Mengembalikan kekuasaan di tangan rakyat. Mengembalikan nilai-nilai Pancasila yang menjamin kedaulatan ada di tangan rakyat.

Saya harus konsisten dengan pilihan perjuangan yang harus saya lakukan dalam kapasitas sebagai pejabat negara, melalui kelembagaan DPD RI. Dimana saya dipilih melalui Pemilu, dan diberi amanat oleh anggota DPD RI untuk memimpin.

Saya juga harus konsisten dengan nilai-nilai Pancasila yang telah final dan seharusnya menjadi grondslag bangsa ini. Sehingga menjadi tujuan hakiki dari gerakan mengembalikan kedaulatan rakyat ini.

Saya harus membangun kesadaran bersama, bahwa kedaulatan rakyat adalah jalan keluar satu-satunya untuk mewujudkan cita-cita hakiki negara ini, yaitu: Keadilan Sosial bagi Seluruh Rakyat Indonesia.

Maka saya katakan, siapapun yang menolak mewujudkan kedaulatan rakyat sesuai nilai-nilai Pancasila, maka dia adalah pengkhianat bangsa. Dialah yang menginginkan ratusan juta rakyat Indonesia tetap terbelenggu dalam kemiskinan dan ketidakadilan.

Para pendiri bangsa ini telah merancang konsepsi utuh Kedaulatan Rakyat yang paling sesuai dengan watak dasar bangsa yang super majemuk ini.

Kedaulatan Rakyat untuk mengatur pemerintahan negara yang berada pada rakyat. Artinya, rakyat berdaulat, berkuasa untuk menentukan cara bagaimana mereka (rakyat) harus diperintah oleh pemerintah yang mereka bentuk.

Keputusan rakyat tersebut harus diambil dalam forum permusyawaratan yang ditetapkan dengan cara mufakat perundingan. Bukan menang-menangan angka. Karena pikiran dan pendapat itu harus ditimbang. Bukan dihitung.

Sehingga bangsa ini membutuhkan Lembaga Tertinggi, sebagai perwujudan Kedaulatan Rakyat. Dimana Lembaga tersebut adalah wadah yang utuh. Yang menampung semua elemen bangsa. Tidak boleh ada yang ditinggalkan.

Mereka semua harus equal. Harus mendapat hak yang sama untuk ikut menentukan arah perjalanan bangsa ini. Sehingga Demokrasi yang kita perjuangkan menjadi Demokrasi yang memberi manfaat kepada seluruh rakyat.

Karena hakikatnya Demokrasi adalah alat bagi rakyat untuk menentukan masa depannya. Termasuk memaksa negara untuk mengelola kekayaan negara untuk sepenuhnya kemakmuran rakyat.

Jadi, ini adalah Demokrasi yang melahirkan Pemerintahan yang diperintah oleh rakyat. Karena pemerintahan itu dibangun atas kehendak rakyat. Inilah yang disebut Demokrasi dari Rakyat, Oleh Rakyat dan Untuk Rakyat.

Karena pada hakikatnya Kedaulatan itu adalah Superanus, yang berarti “yang tertinggi” (supreme). Dan untuk bisa menjadi perwakilan di Lembaga Tertinggi haruslah para hikmat dan para bijaksana.

Konsepsi paripurna dari Demokrasi Pancasila inilah yang belum pernah kita laksanakan secara murni. Bahkan kita tinggalkan total sejak Amandemen Konstitusi tahun 1999-2002 silam.

Inilah yang membuat perjalanan bangsa ini semakin menjauh dari cita-citanya. Dan rakyat, sebagai pemilik negara ini semakin menderita. Karena seperti diungkap sejumlah ekonom, masih ada ratusan juta rakyat yang berpenghasilan 1 juta rupiah per bulan. Padahal negeri ini seharusnya gemah ripah loh jinawi.

Kedaulatan Rakyat harus berada di dalam wadah yang utuh. Yang menampung semua elemen bangsa yang super majemuk ini.

Di dalam wadah tersebut, terdapat partai politik. Terdapat wakil-wakil dari daerah. Dari Sabang sampai Merauke. Dari Miangas sampai Rote. Terdapat wakil-wakil dari golongan-golongan di negara ini. Badan-badan kolektif, koperasi, petani, nelayan, veteran, raja dan sultan Nusantara, ulama dan rohaniawan, cendekiawan, guru, seniman dan budayawan, maha putra bangsa, penyandang cacat dan seterusnya. Terdapat juga wakil-wakil dari TNI dan Polri sebagai alat pertahanan negara dan pelindung masyarakat.

Partai Politik pun harus kembali kepada spirit terbentuknya partai politik yang mengacu kepada Maklumat Wakil Presiden Muhammad Hatta pada 3 November 1945 tentang Pendirian Partai Politik. Dimana di dalamnya jelas memberi Restriksi agar partai politik juga memiliki tanggung jawab mewujudkan cita-cita negara ini.

Sehingga sudah seharusnya anggota DPR RI diisi oleh kader dan aktivis partai terbaik, yang sangat memahami platform perjuangan lahirnya bangsa ini. Bukan diisi oleh siapa saja yang mampu mendulang suara terbanyak dalam pemilu legislatif.

Demikian pula dengan wakil-wakil dari golongan. Mereka adalah tokoh-tokoh terbaik yang diberi mandat oleh organisasinya atau atas pilihan di antara mereka. Sehingga bukan ditunjuk dari atas. Tetapi benar-benar aspirasi dari bawah. Sedangkan wakil-wakil dari daerah adalah tokoh-tokoh putra daerah yang terpilih.

Sehingga prinsip bahwa semua elemen bangsa terwakili mutlak menjadi ciri Demokrasi Pancasila. Untuk kemudian mereka yang disebut dengan Para Hikmat tersebut bermusyawarah mufakat untuk menentukan arah perjalanan bangsa ini.

Sekaligus memilih Presiden dan Wakil Presiden untuk diberi mandat dalam menjalankan roda pemerintahan. Sehingga Presiden dan Wakil Presiden adalah mandataris rakyat. Alias petugas rakyat, yang secara berkala melaporkan kinerjanya kepada pemberi mandat.

Itulah prinsip Syuro dalam sistem tata negara kita yang asli. Atau dapat kita sebut sebagai D.N.A. asli bangsa Indonesia. Konsepsi inilah yang tertuang di dalam naskah Undang-Undang Dasar 1945 naskah asli.

Saya tidak mengatakan UUD 1945 naskah asli sempurna. Mutlak harus dilakukan perbaikan, agar kita tidak mengulang apa yang terjadi di masa lalu. Tetapi penyempurnaan itu harus dilakukan melalui cara yang benar. Bukan ugal-ugalan dan mengganti total Konstitusi, seperti yang kita lakukan di tahun 1999-2002 silam. *
